Delta-9 THC is known for its high psychoactivity levels. This is the compound responsible for getting you high when consuming marijuana. It’s also the reason that the 2018 Farm Bill doesn’t allow certain amounts of THC in organic hemp products — they don’t want people experiencing those mind-altering effects. As discussed, though, delta 8 is only subtly psychoactive, especially compared to delta 9. But, what makes these two similar-sounding cannabinoids act so differently in the body?

This is where things get a little technical. Delta-8 and delta-9 THC have a similar molecular structure; they’re both double-bonded, which scientists believe makes a cannabinoid psychotropic. However, delta 8 THC has the double-bond on the eighth atom, while delta 9 has it on the ninth.

Is Delta-8 Legal in the US?

When you learn about the legality of delta-9 THC in the US, it’s easy to think this applies to D8, too in the cannabis industry. However, that couldn't be further from the truth.

The United States has stated that marijuana and marijuana-derived products are illegal for possession, consumption, and cultivation. This is because of the intoxicating THC values. However, the hemp plant doesn’t contain THC values nearly as high as marijuana does. Instead, it has much higher CBD levels; this makes the plant non-intoxicating and safe for consumption.

Thus, the 2018 Farm Bill states that the hemp plant and hemp-derived products are legal for sales and consumption in the US. However, these products cannot contain more than 0.3% THC. If it is any more than this, then the government prohibits the products entirely.

So, where does delta-8 fall in terms of legality?

Technically, as long as the cannabinoid comes from the hemp plant and doesn’t contain more than 0.3% D9 THC, it is legal under the 2018 Farm Bill. Although not explicitly stated, it falls within the legal confines of the law. That being said, in many states, delta-8 THC products are 100% legal and will remain so unless the federal government says otherwise.

This isn’t the case for all states, though.

Some states recognize the lack of acknowledgment of D8 under the Farm Bill, as well as lack of scientific evidence, and have placed bans or strict restrictions on THC delta-8 products. So, because of this, you have to check with the delta 8 laws in your area. Even though it may be federally legal, certain places have their own agendas. It’s always best to be safe than sorry and make sure you’re legally able to consume delta-8 in your home state.
